1. Bookings & Deposits

All bookings require a non-refundable 50% deposit to secure the date. The remaining balance is due no later than the day before the shoot. Bookings are not confirmed until the deposit has been received and acknowledged in writing.

2. Cancellations & Rescheduling

Deposits are non-refundable. Rescheduling requests made with more than 14 days' notice are accommodated free of charge. Cancellations within 14 days of the shoot forfeit the deposit. Full payment is required for cancellations within 48 hours.

3. Copyright & Usage Rights

All photographs and video content remain the intellectual property of Pixels by Daniela. Clients receive a non-exclusive personal-use licence. Commercial use requires a separate written licence. Pixels by Daniela reserves the right to use images for portfolio and social media purposes unless otherwise agreed in writing.

4. Delivery Timelines

• Real estate photography: 24–48 hours
• Portrait sessions: 7–10 business days
• Weddings and events: 4–6 weeks

5. Liability

Pixels by Daniela exercises all reasonable care during shoots. No liability is accepted for loss of images due to technical failure beyond our control or losses arising from third-party delivery platforms.

6. Governing Law

These terms are governed by the laws of the Republic of South Africa.

1. Parties

Service Provider (Lessor): Daniela, trading as The Archive (Pixels by Daniela), Cape Town, South Africa. Client details are captured and confirmed at the time of booking.

2. Purpose

The Lessee wishes to hire The Archive to provide vintage camcorder rental and editing services for their event. All physical items provided are referred to as 'Equipment'.

3. Equipment

• Vintage Sony Handycam (model specified in booking confirmation)
• 2 × Spare batteries
• 1 × External battery charger
• 1 × Formatted memory card / tape
• Instruction card and shot inspiration guide
• Seeded thank you note
• Return packaging and Pargo return label

4. Fees and Deposit

The full service fee plus the refundable deposit are due before the Equipment is shipped. Payment via EFT. Banking details provided on invoice. The deposit is refunded within 5 business days of the Equipment being received in good condition. The deposit will be forfeited if equipment is returned damaged, late, not returned, or if the memory card has been deleted or formatted.

5. Shipping & Return (Pargo)

Equipment is shipped to the Lessee's nearest Pargo pickup point at least 3 business days before the event. Equipment must be returned by 12:00 PM on the first business day after the event, repacked using original materials, dropped at any Pargo point with the provided return label.

6. Rental Period

Commences on collection from Pargo. Must be returned by 12:00 PM the first business day following the event unless otherwise agreed in writing.

7. Use of Equipment

The Lessee agrees to use Equipment carefully, not attempt repairs or modifications, not allow under-18s to be solely responsible for it, and protect it from water, heat, and physical damage.

8. Damage and Loss

The Lessee assumes full responsibility from collection to confirmed return. Minor damage is invoiced at repair cost. Significant damage or loss is charged at full replacement cost. The deposit is applied first against any costs.

9. Non-Working Equipment

Notify The Archive within 12 hours of collection via WhatsApp or email if equipment is not functioning. We will provide replacement equipment or a full refund.

10. Editing and Deliverables

• 4–5 minute edited film (Solo Kit) or 5–6 minute film (Duo Kit)
• All raw clips via digital download link
• One round of minor revision requests
• Delivered within 21 days of Equipment receipt

11. Footage Rights and Portfolio Use

The Lessee grants The Archive the right to use footage for portfolio and social media. The Lessee retains full personal rights and agrees to credit @thearchive.cpt on social media. A 15% Privacy Fee applies for private bookings.

12. Cancellation and Rescheduling

• More than 30 days before event: deposit forfeited, 100% of service fee refunded
• 15–30 days before event: deposit forfeited, 50% of service fee refunded
• Within 14 days: no refund
• Rescheduling 14+ days prior: no penalty, subject to availability
• Rescheduling within 14 days: treated as cancellation

13. Governing Law

Governed by the laws of the Republic of South Africa. Disputes subject to the jurisdiction of the courts of the Western Cape.
